Preparing for our older years takes a holistic approach that focuses on many facets of our life, including our health, finances, and emotional needs. Many families today are dealing with the rising cost of health care. On top of that, families must also prepare for the possibility of disability or the need for long term care. With the cost of nursing home care, averaging $80,000 a year, it is no surprise that many families are worried about the future.
We advise families on how best to prepare for long term care costs, including assisting clients with Medicaid planning in appropriate situations. We strategize and assist clients in applying to public benefits programs, such as Social Security and Medicaid. In addition, we represent clients at Fair Hearings regarding Medicaid coverage, as well as termination or reduction of long term home care services, such as home health aides or home attendants.
Another critical component of our elder law practice is to assist clients with planning for disability and or dealing with family members who are not competent due to illness or old age to make adequate decisions regarding either their property or their person. In such cases, an Article 81 Guardianship may be necessary. We advise and represent clients throughout the New York City metropolitan area in Article 81 Guardianship cases and also assist clients pro-actively in planning for such issues with advance directives such as power of attorney and a health care proxy.
